On January 21, 2016 the Los Angeles labor law lawyers at Blumenthal, Nordrehaug & Bhowmik filed a class action lawsuit alleging that Panda Express failed to pay their golden state employees the correct amount of overtime wages and allegedly failed to provide their California employees with meal and rest periods in accordance with the California Labor Code. The Panda Express class action lawsuit, Case No. BC607846 is currently pending in the Los Angeles County Superior Court for the State of California. According to the lawsuit, Panda Express allegedly paid their hourly employees non-discretionary bonus wages based on their performance for their assigned restaurant. The lawsuit further alleges that as a matter of law the various bonus wages received by Panda Express' employees should have been included in the employees' hourly rates for the purposes of paying their employees the correct overtime wages. As a result of the alleged illegal overtime calculations conducted by Panda Express, the class action lawsuit claims other non-exempt employees working for the company were also not correctly paid all their overtime wages. The Complaint also seeks penalties relating to alleged missed meal breaks because allegedly Panda Express did not have a policy to provide their restaurant employees thirty (30) minute uninterrupted meal breaks prior to their fifth (5th) hour of work.
