The Sacramento employment law lawyers at Blumenthal Nordrehaug & Bhowmik filed a class action lawsuit seeking overtime wages against BJ's Restaurants, Inc. alleging the restaurant chain misclassified their Kitchen Managers and as a result allegedly failed to pay their Kitchen Managers overtime pay and missed meal break penalties. The BJ's Restaurants, Inc. class action Complaint, Case No. SCV0037417 is currently pending in the Placer County Superior Court for the State of California. The lawsuit claims that the Kitchen Managers spent almost all of their workday expediting food, cutting lettuce, onions and potatoes, washing dishes, cooking food, taking inventory and receiving product shipments, running food to tables and organizing the kitchen in accordance with BJ's company wide policies. The complaint asserts that these are all non-exempt job tasks and the Kitchen Managers should have been paid overtime as a result. The Complaint also alleges that the Kitchen Managers were working over eight hours in a workday and/or over forty hours in a workweek, but because BJ's Restaurants classified the Kitchen Managers as exempt employees they were not allegedly paid the correct overtime pay. As a result, the lawsuit seeks an unspecified amount of back overtime pay for current and former Kitchen Managers working for BJ's Restaurants in California.
