The lawsuit claims that the Kitchen Managers spent almost all of their workday expediting food, cutting lettuce, onions and potatoes, washing dishes, cooking food, taking inventory and receiving product shipments, running food to tables and organizing the kitchen in accordance with BJ's company wide policies. The complaint asserts that these are all non-exempt job tasks and the Kitchen Managers should have been paid overtime as a result. The Complaint also alleges that the Kitchen Managers were working over eight hours in a workday and/or over forty hours in a workweek, but because BJ's Restaurants classified the Kitchen Managers as exempt employees they were not allegedly paid the correct overtime pay. As a result, the lawsuit seeks an unspecified amount of back overtime pay for current and former Kitchen Managers working for BJ's Restaurants in California.
