The Fitness 19 lawsuit, Case No. FCS046697 is currently pending in the Solano County Superior Court for the State of California.
According to the class action complaint the company allegedly paid their personal trainers commission wages based on their performance for Fitness 19. The Complaint further alleges that as a matter of law the commission wages received by Fitness 19's employees should have been included in the employees' hourly rates for the purposes of paying their employees the correct overtime wages. As a result of the alleged illegal overtime calculations conducted by Fitness 19, the class action lawsuit claims other personal trainers working for Fitness 19 were also not correctly paid all their overtime wages.
The Complaint also seeks penalties relating to alleged missed meal breaks because allegedly Fitness 19 did not have a system to provide their personal trainers with thirty (30) minute uninterrupted meal breaks prior to their fifth (5th) hour of work.
