The class action lawsuit claims that the Nurse Case Managers engaged in non-exempt tasks throughout their shifts, including reviewing client's pre-injury positions, making appointments with patients' doctors, communicating in-person and by telephone with patients, employers, medical providers, attorneys, insurance carriers and claims adjusters.
The class action lawsuit against Liberty Mutual also claims Nurse Case Managers should be paid overtime pay because the Case Managers allegedly use their RN training to coordinate care, act as intermediaries between patients, adjusters, and doctors and operate in a framework in "which these employees do not exercise ultimate decision making power." The lawsuit seeks an unspecified amount of back overtime pay for Nurse case Mangers who worked for Liberty mutual in California.
