The lawsuit alleges that Liberty Mutual Managed Care LLC ("Liberty") misclassified their Nurse Case Managers and allegedly failed to pay these employees overtime pay and allegedly failed to provide the Nurse Case Managers with the proper meal periods. The class action lawsuit claims that the Nurse Case Managers engaged in non-exempt tasks throughout their shifts, including reviewing client's pre-injury positions, making appointments with patients' doctors, communicating in-person and by telephone with patients, employers, medical providers, attorneys, insurance carriers and claims adjusters.
The class action lawsuit against Liberty Mutual also claims Nurse Case Managers should be paid overtime pay because the Case Managers allegedly use their RN training to coordinate care, act as intermediaries between patients, adjusters, and doctors and operate in a framework in "which these employees do not exercise ultimate decision making power."
