According to the lawsuit, Inter-Coast allegedly failed to follow California labor laws by misclassifying their Instructors as exempt from overtime pay and thus refused to pay these employees for their overtime hours worked. Specifically, the Complaint alleges that the Instructors consistently engaged in non-exempt tasks such as adhering to course outlines, grading exams, and submitting attendance reports to Inter-Coast. As a result, the Complaint claims the instructors working for Inter-Coast in California should have been paid overtime wages for time worked in excess of eight (8) hours in a workday and forty (40) hours in a workweek.
