The Complaint further alleges that under California law the commission wages received by West Covina Corporate Fitness employees should have been included in the employees' hourly rates for the purposes of paying their employees the correct overtime wages. As a result of the alleged illegal overtime calculations conducted by West Covina Corporate Fitness, the class action lawsuit claims other personal trainers working for the fitness company were also not correctly paid all their overtime wages.
The lawsuit also seeks an unspecified amount of penalties relating to alleged missed meal and rest breaks because West Covina Corporate Fitness purportedly did not have a system to provide their personal trainers with thirty (30) minute uninterrupted meal breaks prior to their fifth (5th) hour of work.
