Highlights of selected legislation covered in the newly updated protocol include:
• "Energy Code, Book II, Title III, Chapter III, as codified by Law 2013-619 of 16 July 2013," was added to the “General Environmental” module for this update. This part of the Code serves as the framework for conducting energy audits and implementing energy management systems. In addition to this Code, references to the following national legislation related to energy efficiency auditing were added:
• "Decree No. 2014-1393 of 24 November 2014" implements Article 8 of the "Directive 2012/27/EU" regarding energy efficiency and defines the modes for performing the required energy audits as well as the conditions of exemption regarding audit obligations;
• "Decree No. 2013-1121 of 4 December 2013" defines the threshold values above which legal entities must conduct an energy audit of their activities; and
• "Order of 24 November 2014" specifies the terms of application of the audit obligation and defines in particular the audit methodology as well as the requirements for auditor qualifications.
• "Order of 29 July 2014 regarding the Criteria for Classifying Wood Packaging as Non-Waste for a Use as Combustible Type Biomass in a Combustion Installation, as amended through the Order of 19 June 2015" was enacted. This Order establishes the criteria which must be satisfied in order to change the status of shredded wood packaging from waste to non-waste for direct use as biomass fuel in a combustion plant.
• "Order of 4 August 2014 on Classified Installations submitted to Declaration under Heading No. 4802" was added to this update. This Order establishes requirements for Classified Installations that manufacture, use or store fluorinated greenhouse gases covered by Regulation (EC) No 842/2006 or substances that deplete the ozone layer covered by "Regulation (EC) No 1005/2009" (facilities declared under Heading No. 4802, formerly Heading No. 1185).
• "Regulation No. 517/2014 of the European Parliament and of the Council of 16 April 2014 on Fluorinated Greenhouse Gases and Repealing Regulation (EC) No 842/2006" was added to this update. This Regulation requires operators of equipment containing fluorinated greenhouse gases to take every precaution to avoid any leakage and to ensure that equipment is regularly checked for leaks. Producers, importers, exporters, users of feedstock and businesses that destroy F-gases must report annually to the Commission. Importers of F-gases equipment must do the same and from 2017 provide evidence that the quantities of HFCs in their imported equipment are accounted for.
• "Order of 28 October 2013 Relative to the Content of the Application for a Specific Decontamination and Disposal Planning regarding Equipment Containing PCB" was added to this update. This Order presents the required documents to be provided in order to apply for a specific plan regarding the decontamination and disposal of PCB containing equipment. This order only applies to holders of more than 150 pieces of equipment containing PCB.
• "Order of 7 January 2014 Relative to the Methods of Analyses and Labeling and the Conditions for Holding PCB Containing Devices" was enacted. This Order presents the norms of references for the PCB analyses as well as the requirements regarding the labeling of devices containing PCB and the prescriptions for holding PCB containing devices (storage, use and handling).
• "Order of 14 January 2014 Relative to the Declaration of Holding PCB Containing Equipment" was enacted. This Order requires a mandatory declaration of any equipment containing more than 5 dm³ of PCB containing (or assumed containing) fluid.
• "Environmental Code, as codified by Ordinance 2000-914 of 21 September 2000, Law 2003-591 of 3 July 2003, and Decree 2005-935 of 2 August 2005, as amended through Ordinance No. 2015-1324 of 22 October 2015" were referenced in the “Equipment, Machine and Electrical Safety” module for this update. The Environmental Code was modified by "Decree no. 2015-799 of July 2015" regarding high risk equipment which repealed "Decree No. 2001-386 of 3 May 2001, Mobile Pressurized Equipment," as amended through "Decree No. 2011- 758 of 28 June 2011," and "Order of 3 May 2004 Regarding the Operation of Mobile Pressurized Equipment. Chapter VII" was added to Tittle V of Book V and pertains to the compliance of high risk equipment with the applicable norms and regulations; sections 10, 11 and 15 of Chapter VII are dedicated to pressurized vessels.
• "References to Circular DGT/2012 of 9 October 2012 Concerning the Prevention of Electrical Risks" were added to this update. This Circular is considered legally binding and supports a series of national decrees and implementing orders set the goals of safety and define the principles fundamental in preventing electrical hazards. It provides explanations and clarifications on regulatory obligations, particularly regarding the verification of electrical installations and content of the required documents and records.
• "Order of 18 November 2004 on the Safety Work to be Performed in Elevator Installations, as amended through Order of 10 December 2014" was added to this update. This Order specifies the safety devices which had to be installed in elevator installations before 31 December 2010 as well as before 3 July 2014. It also presents the safety devices which will have to be in place before 3 July 2018.
• "Order of 2 March 2015 Regarding the Circulation Prohibition for Vehicles Transporting Goods at Certain Periods of Time" took effect as of this update. This Order presents the general and specific prohibitions for circulation pertaining to vehicles transporting goods with more than 7.5 tonnes as well as derogations to this prohibition. This order replaced the "Order of 11 July 2011" regarding the circulation prohibition for vehicles transporting goods at certain periods of time. "Circular of 4 August 2015 in Application of Order of 2 March 2015 Regarding the Prohibition of Circulation for Vehicles Transporting Goods at Certain Periods of Time" was also included in this update to clarify the provisions of the Order of March 2, 2015 on the prohibition of circulation of freight vehicles at certain times for vehicles with a total permissible load weight exceeding 7.5 tonnes. It also specifies the conditions for the granting of exemptions and the details regarding the instruction of exemption applications.
• "Order of 17 July 2013 Regarding the Medical Monitoring Record and the Dosimetric Monitoring of Workers Exposed to Ionizing Radiation" was added to this update. This Order provides details for the content of the medical monitoring record, the transfer of the information to the authorities and the methods to apply for the dosimetric monitoring.
• "Order of 14 December 2013 on Cooling Installations that Disperse Water Into an Air Stream Subject to Declaration under Heading 2921" was enacted. This Order applies to facilities with cooling installations (i.e., cooling towers) that disperse water into an air stream which are subject to declaration under Heading No. 2921 of the Nomenclature of Classified Installations. This Order includes special provisions for the prevention of Legionella.
• "Order of 22 July 2015 Regarding Approval of the Decision No. 2015-DC-0506 of the Nuclear Safety Authority Regarding the Conditions for Performing the Measures of Radon Activity in Application of Article R. 1333-15 of the Public Health Code" was enacted. This Order presents the norms to be used for the measurement of radon activity as well as the period when these measures must be performed.
• "Order of 26 May 2014 on the Prevention of Major Accidents in Installations Classified as Defined by Section 9, Chapter V, Title I of Book V of the Environmental Code" was added to this update. This Order discusses the prevention of major accidents in Classified Installations for the protection of the environment, implementing the "Directive (EC) 2012/18/EC (Seveso III Directive) in French Regulation. This Order replaces Order of 10 May 2000 on the Prevention of Major Accidents Involving Hazardous Substances in Certain Categories of Installations Classified for the Protection of the Environment that Require an Authorization."
