The class action lawsuit claims that Interstate Management paid their non-exempt employees non-discretionary incentive pay based on their performance for the company. The Complaint further alleges that as a matter of law the incentive pay received by Interstate Management Company's employees should have been included in the employees' hourly rates for the purposes of paying them the correct overtime pay. The class action lawsuit further alleges that other non-exempt employees working for the company were also not correctly paid all their overtime wages.
The Complaint also seeks penalties relating to alleged missed meal breaks because allegedly Interstate did not have a policy to provide their California employees thirty (30) minute uninterrupted meal breaks prior to their fifth (5th) hour of work.
