HB 300 is a Texas-specific legislation that builds on HIPAA federal regulation. It significantly broadens the federal HIPAA definition of a Covered Entity operating or doing business in Texas to include any person or entity who comes into contact with PHI in any way. In addition, HB 300 sets formal standards for the handling of electronic health records (EHRs) and allows patients a 15 day window to access their EHRs upon request. HB 300 also standardizes stricter civil and criminal penalties for unregulated electronic distribution or disclosure of PHI, with fines ranging from $5,000 per breach to $1.5 million for a pattern of PHI abuse.
