The Sacramento Labor Law Lawyers at Blumenthal, Nordrehaug & Bhowmik File a Class Action Lawsuit Against Bitech, Inc. that Alleges California Labor Code Violations
Sacramento, California (PRWEB) November 10, 2016 -- The Sacramento employment law lawyers at Blumenthal, Nordrehaug & Bhowmik filed a class action lawsuit alleging that Bitech, Inc. doing business in California as Performance Bicycle Shop failed to pay their hourly employees the correct amount of overtime wages and allegedly failed to provide their California employees with meal and rest periods in accordance with the California Labor Code. The Bitech, Inc. doing business as Performance Bicycle Shop lawsuit, Case No. 34-2016-00202022 is currently pending in the Sacramento County Superior Court for the State of California. A copy of the Complaint can be read here.
According to the class action complaint the company allegedly paid their non-exempt employees non-discretionary incentive wages based on their performance for the company. The Complaint further claims that as a matter of law the incentive wages received by Bitech's employees should have been included in the employees' hourly rates for the purposes of paying their employees the correct overtime wages. As a result of the alleged illegal overtime calculations conducted by Bitech, Inc. doing business in California as Performance Bicycle Shop, the class action Complaint claims other hourly employees working for the company were also not correctly paid all their overtime wages.
Additionally, the lawsuit also seeks payment relating to alleged missed meal breaks because allegedly the company did not have a policy to provide their retail store employees thirty (30) minute uninterrupted meal breaks prior to their fifth (5th) hour of work.
