Rosner pursued compensation on behalf of plaintiff Anthony Marfoglio, who sustained serious injuries while installing plumbing on a residential construction site located in East Quogue. The lawsuit (Anthony Marfoglio and Eileen Marfoglio v. Meadowcrest Homes @ Greenville LLC., Meadowcrest Distinctive Homes, Robert Strecker, Robert F. Strecker and Sunrise to Sunset Construction Corp., No. 17226/08, filed in Suffolk County Supreme Court) alleges that the defendants violated the New York State Labor Law § 241(6) by failing to provide reasonable protection at the work site.
The injury took place on February 26 of 2008, when a staircase collapsed beneath the plaintiff’s feet, causing the 58-year-old plumber to incur injuries to his cervical spine, knee, wrist and elbow. The complaint alleged that the prefabricated staircase was not properly secured, thus violating labor laws.
According to court documents, the project’s general contractor denied liability on grounds that they did not install the staircase and advised the property owners that the prefabricated structure was not ready for installation. Marfoglio underwent medical treatment, surgery and physical therapy for various traumas including cervical disc injury, ulnar nerve damage and injuries to his right knee. The claim sought monetary damages for past and future pain and suffering.
Court documents also state that Attorney Allen J. Rosner entered into pretrial negotiations with defense counsel, realizing a total settlement of $1,500,500, of which $1 million was covered by the defendants’ insurance policies. The settlement amount reflects the physical limitations and residual pain that prevent Marfolglio from resuming manual labor as a plumber.
