At a Code Enforcement Hearing before the Special Magistrate of the Town of Surfside, Florida, the attorneys at PeytonBolin successfully argued that the Town of Surfside had failed to properly place the clients on a timely notice of the reported violations and then took no action to bring the case forward until after the fines had grown to unreasonable amounts. The firm’s lawyers proved that once the Mediterranean Condominium Association and its individual unit owners were placed on notice of the alleged violations, they immediately resolved the town’s concerns, and also that the issues at hand posed no actual harm to the human health, safety or welfare of the community.
