Tip Sheet on How to Change Ownership of Timeshares located in California, Florida, Hawaii and Nevada by Deed and Record

For any non-sale change in ownership as described in the prior paragraph, two events must happen. First a deed must be prepared and then submitted to the entity of the state responsible for maintaining the records of real property ownership. Second a copy of the recorded deed must be provided to the timeshare company.
A deed is a document signed by the current owner transferring all or part of his or her ownership in real property to another person. The owner either “grants” or “quit claims” ownership. The term “grant” has warranties of good title. The term “quit claim” is the equivalent of “as is” without any promises of valid ownership.
California, Hawaii and Nevada require the owner’s signature on the deed to be acknowledged before a notary. Florida in addition to the acknowledgement requires the owner’s signature on a deed to be witnessed by two individuals.
After the deed is prepared and the signature verified, the deed must be recorded. In Florida, the courthouse in each county tracks timeshare ownership. California and Nevada have a recorder’s office in each county to document and verify ownership. Hawaii is the only state that does not track of timeshare ownership by County. Instead, Hawaii tracks timeshare ownership with a state government agency called the “Bureau of Conveyances.”
After the deed and been prepared and recorded, a copy of the recorded deed must be provided to the timeshare company to update their records of ownership. Timeshare companies will have additional documentation requirements, depending on the company. These companies will also require a fee to update those records. Fees vary from $25 to $500.
