Paul M. Seby, shareholder in global law firm Greenberg Traurig,LLP’s Environmental Practice, spoke at the 2017 National Conference of Regulatory Attorneys (NCRA) May 10 at the Hilton Portland & Executive Tower. He participated on the panel, “Natural Gas Pipeline Siting.”

The panel provided an update on administrative and litigation developments related to several major federal energy and environmental regulations that are subject to recent Presidential Executive Orders mandating their prompt review and potential reconsideration. The Executive Orders also seek to promote energy independence and economic growth through the identification of impediments to burdens on increased domestic energy production and transmission. States may play an increased role in overseeing energy development and production in the renewed context of the cooperative federalism called for under most major federal energy and environmental laws. This panel also explored the federal and state legal frameworks governing pipeline siting and safety and some of the practical issues that utilities confront when siting, planning, and constructing energy-related infrastructure projects.

The NCRA is open to all utility regulatory attorneys having statutory responsibility for working with or appearing before state or federal regulatory agencies. The NCRA provides educational opportunities specifically tailored to government utility regulatory attorneys, with a focus on state regulatory issues. The NCRA covers a wide variety of regulatory topics, including electricity, gas, water, telecommunications, federal regulations, and ethics. NCRA works to keep participants informed about recent developments and trends in public utilities regulation and seeks to provide a balanced opportunity for debate and discussion of legal regulatory issues.

Seby is a leading practitioner in the Rocky Mountain region, with nearly 25 years' experience analyzing a myriad of environmental issues. He counsels public and private clients in the energy, mining, manufacturing, and service industries on how to navigate and successfully operate within the complex framework of state and federal environmental regulations and policies. Seby has vast experience prosecuting cases to enforce and overturn administrative agency regulations and decisions, and has defended clients in federal and state enforcement proceedings, in appearances before the U.S. Supreme Court, several U.S. Courts of Appeal, and the Colorado Supreme Court, among others. Bearing in mind that a successful outcome is often a combination of traditional and non-traditional legal strategy, Seby leverages his experience to negotiate with government agencies and adversary groups.
