Family of Boston Letter Carrier Receives $6.8M Asbestos Verdict
BOSTON, MA (PRWEB) October 06, 2017 -- A Boston jury has handed down a verdict of $6.8 million dollars to the family of a local U.S. postal worker against New England Insulation (NEI). According to court documents, Timothy Ross, who worked as a part-time insulator when he was in middle and high school and for several years as a young man, was exposed to asbestos dust while repairing and replacing asbestos insulation on boilers, hot water tanks, and pipes in the Boston area. As a result, Mr. Ross was diagnosed with the asbestos-related cancer, mesothelioma, in late 2012 and died from his disease nine months later, according to evidence submitted at trial. The case is Civil Action No. 13-5580; Amy Ross Individually and as Personal Representative of the Estate of Timothy J. Ross v. A.O. Smith Corporation, et al; Middlesex County Superior Court, Common Wealth of Massachusetts.
Lead trial attorney and Waters Kraus & Paul partner, Peter Kraus, commented on the outcome saying that, “this verdict demonstrates that team work and a strong case with clear exposure and liability evidence can extend the scope of responsibility to all sellers, who knowingly provide harmful products to unsuspecting consumers.”
Mr. Ross began experiencing breathing difficulty in December 2012 and was diagnosed with mesothelioma a week before Christmas. He underwent surgery and chemotherapy to treat his mesothelioma, but succumbed to the disease only nine months later. He leaves behind his wife Amy Ross, their two daughters, and two grandchildren.
The Ross family is represented by Peter Kraus and Chris Johnson with Waters Kraus & Paul of Dallas and co-counsel Andrew Wainwright and Andrea Marino Landry with the Thornton Law Firm of Boston.
