The Sacramento Labor Lawyers at Blumenthal Nordrehaug & Bhowmik Sue Guckenheimer Enterprises, Inc., for Allegedly Failing to Pay Chef Managers Overtime
SACRAMENTO, Calif. The lawsuit claims that the Chef Managers spend most of their time engaging in non-exempt labor including, powering up kitchen equipment including the griddle, steam tables, coffee maker etc., checking the cold equipment temperatures, stocking ice,
cooking daily breakfast and lunch meals, washing dishes, gathering cold-prep items from the cooler and assembling items on cold preparation table, preparing soups, assisting in closing duties, including but not limited to, pulling floor mats, mopping, sweeping, ordering food supplies, generating end of sales reports, and making bank deposits for Guckenheimer Enterprises, Inc., in accordance with Guckenheimer Enterprises, Inc.'s company policies. As a result, the lawsuit alleges that the Chef Managers should be paid overtime wages and provided with the legally required thirty minute uninterrupted meal periods.
Further more, the lawsuit alleges that Guckenheimer Enterprises, Inc., committed acts of unfair competition in violation of the California Unfair Competition law, Cal. Bus. & Prof. Code §§ 17200, et seq., by engaging in a uniform company-wide policy, practice and procedure which fails to properly classify Chef Managers and thereby fails to pay them overtime wages for documented overtime worked.
