Maglio Christopher & Toale, P.A. Files Lawsuit on Behalf of 3 Washington Hip Replacement Patients Who Allege Injuries from Defective Metal on Metal Biomet Magnum Hips
SEATTLE (PRWEB) December 01, 2017 -- Three patients suffering from heavy metal poisoning, allegedly caused by Magnum metal on metal hip replacements, filed a lawsuit Tuesday in Seattle, Washington against hip manufacturer Biomet Orthopaedics. The patients say they experienced heavy metal poisoning, tissue and muscle necrosis, pseudotumors, and unnecessary revision surgeries because of a defectively designed Magnum hip implant, as alleged in the attached complaint (Case No. 17-2-30517-1 SEA).
The lawsuit also alleges that Biomet sold the Magnum hip replacement without conducting clinical testing, and allegedly never warned the plaintiffs or their surgeons about the risks of high metal ion levels from the Magnum hips, despite being presented with evidence of a problem.
According to the documents filed in court this week, patient Ellen Pardee of Seattle alleges the Magnum hip implanted in her body caused a pseudocyst, severe tissue damage around her IT Band, destroyed muscle, and gave her heavy metal poisoning. James Millard alleges in the complaint that doctors diagnosed him with high levels of cobalt and chromium metal poisoning triggered by his Magnum implant. Alan Rossi also states in the lawsuit that the Magnum hip caused high metal ion levels in his body. All three plaintiffs needed additional surgeries to remove the metal on metal Magnum hips and replace them with a metal-on-plastic type of hip implant.
The case is Rossi v. Biomet, Inc. filed in King County Superior Court, case number 17-2-30517-1 SEA (file attached)
