The Sacramento Employment Law Attorneys at Blumenthal, Nordrehaug & Bhowmik Sue Vision Precision Holdings, LLC for Allegedly Failing to Pay Overtime Wages
SACRAMENTO, Calif. (PRWEB) December 08, 2017 -- The Sacramento labor law attorneys at Blumenthal, Nordrehaug & Bhowmik filed a class action lawsuit against Vision Precision Holdings, LLC, alleging that the company failed to properly calculate overtime compensation for their hourly employees. Furthermore, the complaint alleges that Vision Precision Holdings, LLC, failed to provide mandatory meal and rest breaks to its employees. The Vision Precision Holdings, LLC, lawsuit Case No. 17CECG03925, is currently pending in the Fresno County Superior Court for the State of California. A copy of the complaint can be accessed by clicking here.
The class action complaint claims that the company paid their non-exempt employees a non-discretionary incentive wage based upon their performance for the company. The complaint claims that the company allegedly failed to properly pay the correct amount of overtime compensation due to their non-exempt employees because the company allegedly failed to include the incentive wage compensation as part of the employees' "regular rate of pay" for purposes of calculating overtime compensation. As a result, the complaint claims that non-exempt employees working in California were systematically underpaid overtime compensation.
According to the class action complaint, the company's non-exempt employees were also allegedly unable to take off duty meal breaks due to their rigorous work schedules. California labor laws require an employer to provide an employee required to perform work for more than five (5) hours during a shift with, a thirty (30) minute uninterrupted meal break prior to the end of the employee's fifth (5th) hour of work. The complaint claims that the company did not provide their employees who forfeited meal breaks additional compensation.
