Grieving Family Files $5 Million Lawsuit Against Nursing Home for 2015 Death of Mother & Grandmother
Portland, OR (PRWEB) September 08, 2017 -- The Law Offices of Paul Galm, Attorney at Law, LLC, filed a wrongful death lawsuit on June 28, 2017, in Multnomah County Circuit Court on behalf of Dianne E. Hayes, the daughter of Lucille Troxel who died on April 15, 2015, after admission to Prestige Care, Inc.’s Hood River Care Center, located in Hood River, Oregon (Multnomah County Circuit Court Case # 17CV26943). The lawsuit alleges that Prestige Care, Inc., and Hood River Care Center failed to provide proper care for Lucille Troxel, including failing to administer medications, follow doctor’s orders and sufficiently staffing the care center. The lawsuit claims over $5 million for pain and suffering, as well as loss of companionship, support and services. The lawsuit indicates that it may be amended in the future to allege punitive damages against the defendants.
The lawsuit further alleges that the Oregon Department of Human Services, Office of Licensing and Regulatory Oversight, investigated Lucille Troxel’s death and ultimately found multiple state and federal deficiencies, including failure to provide the necessary care per physician order; failure to adequately staff to meet resident needs; and failure to provide the necessary care to prevent or treat Lucille Troxel’s worsening medical condition. The lawsuit also alleges that the Hood River Care Center did not appeal these findings and paid a fine.
According to probate court documents related to the wrongful death lawsuit, Lucille Troxel was 93 years old at the time of her death. The court appointed Dianne Hayes as the personal representative of Lucille’s estate for purposes of litigating the wrongful death lawsuit.
