Highlights of selected legislation covered in the newly updated protocol include:
• “Government Regulation Number 107 Year 2015 Regarding Industrial Business License, December 28, 2015” repealed and replaced “Government Regulation No. 13 of 1995 on Industrial Business Licenses, May 23, 1995.” This legislation establishes the procedures for obtaining an Industrial Business License.
• “Government Regulation Number 142 Year 2015 Regarding Industrial Estates, December 28, 2015” repealed and replaced “Government Regulation No. 24 of 2009 Regarding Industrial Zone.” This Regulation establishes requirements, including the provisions to prepare an environmental plan and obtain the appropriate licenses, for facilities located in industrial estates.
• “Regulation of Minister of the Environment and Forestry Number P.102/MENLHK/SETJEN/ KUM.1/12/2016 Regarding the Environmental Documents for Businesses and/or Activities that have Obtained a Business License But Do Not Have Environmental Documents; December 30, 2016” repealed and replaced “Minister of Environment Regulation No. 14 of 2010,” of the same title. This Regulation provides guidelines for the criteria, evaluation, review, and funding of Environmental Documents (DELH, DPLH).
• “Regulation of the Minister of Environment and Forestry No.P.87/Menlhk/Setjen/Kum.1/11/2016 Regarding the Electronic Reporting System for Environmental Permits for Businesses and/or Activities, December 6, 2016” was newly added to the Protocol. It provides guidelines and provisions for businesses or activities to electronically report through SIMPEL for the implementation of environmental management and monitoring (RKL/RPL or UKL/UPL), water pollution control, air pollution control, hazardous and toxic waste management, and control of damage to the environment.
• “Regulation of the Minister of Trade No. 83/M-DAG/PER/10/2015 Regarding Provisions for Import of Ozone Depleting Substances (ODS), October 8, 2015” repealed and replaced the “Regulation of the Minister of Trade No. 03/M-DAG/PER/1/2012 Regarding Provisions for Import of Ozone Depleting Substances.”
• “Regulation of the Minister of Environment and Forestry No. P.70/MENLHK/SETJEN/ KUM.1/8/2016 Regarding Emission Quality Standards of Businesses and/or Activities of Thermal Processing of Wastes” was newly added to the Protocol. It establishes requirements relating to emissions resulting from thermal processing of wastes.
• “Regulation of the Minister of Environment and ForestryNo.P.73/MenLHK/Setjen/ Kum.1/12/2017 Regarding the Guidelines for the Implementation of National Greenhouse Gas Inventory, December 29, 2017” was newly added to the Protocol. It supports the “Regulations of the President of Indonesia No. 71 Year 2011” by detailing provisions on the implementation of the National GHG Inventory.
• “Regulation of the Minister of Trade No. 31/M-DAG/PER/5/2016 Regarding the Provisions for Import of Non Hazardous and Toxic Wastes” was newly added to the Protocol to detail requirements regarding the import of non-hazardous and toxic (non-B3) wastes.
• “Regulation of Minister of Environment and Forestry of Republic of Indonesia Number P.56/Menlhk-Setjen/2015 Regarding the Technical Procedure and Requirements for Hazardous and Toxic Waste Management at Healthcare Facilities” was newly added to the Protocol in order to provide the requirements for healthcare facilities managing medical wastes.
• “Regulation of the Minister of Public Works Number 01/PRT/M/2016 Regarding Permit Procedures for the Commercialization and Use of Water Resources, January 25, 2016” repealed and replaced the “Minister of Public Works Regulation No. 49/PRT/1990 Regarding the Procedure and Requirements of Permits for Water Use.” The Regulation establishes provisions for obtaining a permit for water use for businesses and for consumption.
• “Regulation of the Minister of Public Works No. 11/PRT/M/2014 Regarding Rainwater Management for Buildings and Building Premises, September 24, 2014” was newly added to the Protocol to flush out requirements regarding the management of stormwater.
• “Government Regulation Number 121 Year 2015 Regarding the Utilization of Water Resources, September 28, 2015” was newly added to the Protocol to establish general provisions on water use. It revoked “Government Regulation No. 22 Year 1982.”
• “Regulation of Minister of Environment and Forestry Number P.68/MENLHK-SETJEN/2016 Regarding the Quality Standard of Domestic Wastewater; August 9, 2016” was newly added to the Protocol to detail requirements on processing domestic wastewater. It revokes the “Decree of the Minister of Environment No. 112 Year 2003.”
• “Regulation of the Minister of Manpower Number 37 Year 2016 Regarding Occupational Safety and Health of Pressure Vessels and Storage Tanks, December 27, 2016” was newly added to the Protocol. It establishes requirements related to the design, manufacturing, fabrication, assembly, usage or operation, repair, maintenance, modification, inspection and testing of pressure vessels and storage tanks.
• “Regulation of the Minister of Health No. 56 Year 2016 Regarding the Implementation of Healthcare Services for Work-Related Illnesses, October 24, 2016” was newly added to the Protocol to detail the requirements regarding work-related illnesses, including diagnoses, procedures, and healthcare services provided by occupational medical service providers.
• “Decree of the Director General of Industrial Relationship and Manpower Supervision No. Kep.311/BW/2002 regarding Occupational Safety and Health Competence Certification for Electrical Technician” was newly added to the Protocol to include the general provisions on the occupational safety and health competencies of electrical technicians.
• “Regulation of the Minister of Manpower No. 38 Year 2016 Regarding Occupational Safety and Health of Power and Production Engines, December 27, 2016” was newly added to the Protocol to include requirements on the design, fabrication/manufacturing, installation/assembly, usage/operation, maintenance, repair, modification, inspection and testing of power and production engines.
• Two new regulations were added to the Protocol to include specific requirements relating to work in confined spaces. These regulations are: “Decree of the Director General of Binawasker No. Kep.113/DJPPK/IX/2006 regarding Technical Guidelines and Training for Occupational Safety and Health Officers of Confined Spaces, September 29, 2006” and “Distribution Letter of the Minister of Manpower and Transmigration No. SE.01/MEN/PPK/IV/2012 regarding Compliance with Obligatory Provisions of Occupational Safety and Health for Confined Spaces, April 9, 2012.”
• Regarding transportation of dangerous goods, three regulations were expanded upon to provide comprehensive covered of this topic. These regulations include: “Decree of the Head of BAPEDAL No. KEP-02/BAPEDAL/09/1995 Regarding Hazardous and Toxic Waste Document, September 05, 1995;” “Government Regulation No. 74 Year 2001 Regarding the Management of Hazardous and Toxic Materials, November 26, 2001;” and “Decree of the Director General of Land Transportation No. SK.725/AJ.302/DRJD/2004 Regarding Transportation of Hazardous and Toxic Materials (B3) on the Road, April 3, 2004.”
• “Regulation of the Minister of Health No. 492/MENKES/PER/IV/2010 Regarding Provisions for Drinking Water Quality, April 19, 2010” was added to the Protocol to incorporate water quality standards for the supply of drinking water.
• “Regulation of the Minister of Health No. 70 Year 2016 Regarding the Standards and Provisions for Industrial Work Environmental Health, December 23, 2016” was newly added to the Protocol. This Regulation establishes occupational exposure limits.
• “Regulation of the Minister of Health No. 32 Year 2017 Regarding Environmental Health Quality Standards and Health Provisions for Water Used for Hygiene Sanitation Purposes, Swimming Pools, Solus Per Aqua (SPAs), and Public Bathrooms, May 31, 2017” was newly added to the Protocol. It establishes water quality standards for certain water sources, including water used for sanitation and hygiene purposes.
• “Regulation of the Minister of Health No. 258/Menkes/Per/III/1992 Regarding Health Provisions for Pesticide Management, March 30, 1992” and “Regulation of the Minister of Agriculture No. 39/Permentan/SR.330/7/2015 Regarding Pesticide Registration” were newly added to the Protocol to flush out requirements regarding the management of pesticides.
• “Regulation of the Minister of Environment and Forestry Number P.36/MENLHK/SETJEN/ KUM.1/6/2017 Regarding the Procedures for Registration and Notification of Hazardous and Toxic Materials” was newly added to Section 16.0 – Chemical Management of the Protocol to flush out some relevant requirements regarding the registration and notification of hazardous and toxic materials.
• “Regulation of the Minister of Trade No. 19 Year 2018 regarding the Provisions for Import of Lubricants” was newly added to the Protocol. This Regulation establishes new requirements regarding the import of lubricants.
• “Regulation of the Minster of Manpower Number 9 Year 2016 Regarding Occupational Safety and Health Requirements for Working at Heights, March 10, 2016” was newly added to the Protocol. The Regulation establishes requirements related to work activities that are conducted at heights.
