The Sacramento labor law attorneys at Blumenthal Nordrehaug Bhowmik De Blouw LLP, filed a class action lawsuit against Patrick K. Willis Company, Inc., alleging that the company failed to accurately calculate and record overtime compensation for their hourly employees. Furthermore, the complaint alleges that Patrick K. Willis Company, Inc., failed to provide mandatory meal and rest breaks to its employees. The Patrick K. Willis Company, Inc., lawsuit Case No. 34-2018-00234487, is currently pending in the Sacramento County Superior Court for the State of California. The class action complaint alleges that Patrick K. Willis Company, Inc., failed to accurately pay PLAINTIFFS and the other members of the CALIFORNIA CLASS overtime wages for the time they worked which was in excess of the maximum hours permissible by law as required by Cal. Lab. Code §§ 510, 1194& 1198. Cal. Lab. Code § 510 further provides that employees in California shall not be employed more than eight (8) hours per workday and/or more than forty (40) hours per workweek unless they receive additional compensation beyond their regular wages in amounts specified by law.
According to the class action complaint, the company's non-exempt employees were also allegedly unable to take off duty meal breaks due to their rigorous work schedules. California labor laws require an employer to provide an employee required to perform work for more than five (5) hours during a shift with, a thirty (30) minute uninterrupted meal break prior to the end of the employee's fifth (5th) hour of work. The complaint alleges that the company did not provide their employees who forfeited meal breaks additional compensation.
