Attorney Says Right to Abortion was ‘Pure Invention’ of Supreme Court, as are its ‘Recent Liberty Interests’

In the book, Powers argues that the Supreme Court, “using the pernicious doctrine of sociological jurisprudence,” became a policy-making body that anticipates “the desires of the liberals.” Working under a “perceived entitlement,” Powers contends the Supreme Court simply custom-invented the Doctrine of Marital Privacy for Planned Parenthood.
“What passed for the legal reasoning which created the right of privacy for Planned Parenthood in the first place was so absurd that, once the court had expanded it to include the right to kill living human beings by abortion, it lost no time in abandoning it for the latest figment of its imagination, the liberty interest basket of rights it invented in 2003,” says Powers. “This even sharper weapon is now used to strike down whatever state laws it and the liberals don’t like. Actually, the ONLY way to create a liberty interest basket of rights is to amend the constitution by a two thirds vote of congress. Despite its knowledge of this exclusive method, the supreme court prefers to amend the constitution judicially because – after all, it’s the supreme court, and it can get away with it because the public won’t be any the wiser.”
