The Judicial Panel on Multidistrict Litigation ruled recently that national IVC filter lawsuits filed against Bard would be consolidated as multidistrict litigation in U.S. District Court in Arizona, according to court documents. The MDL, known as Bard IVC Filters Products Liability Litigation, initially provides for the transfer of 22 actions currently pending in courts around the country, according to the Transfer Order. The attorneys representing Bard IVC filter lawsuits for the Onder Law Firm provide this commentary on the recent development:
“We were glad to see the decision of the JPML to consolidate Bard IVC filter lawsuits. While plaintiffs weren’t awarded the District Court location they had requested, we believe the consolidation of these actions is positive for our clients and other families involved in Bard filter lawsuits nationwide.
“Multidistrict litigation is a legal process that allows for coordinated pretrial proceedings to take place for lawsuits that are essentially the same. In this case, the group of plaintiffs includes people who were implanted with a Bard IVC filter and allege they suffered an injury related to the device.
“By conducting discovery all at once for cases which make the same allegations, the courts eliminate contradictory rulings and promote efficiency. As a leading product liability law firm, we also believe plaintiffs stand to benefit because of the powerhouse of law firms contributing resources and work across the board on their cases.
“Our firm is fielding calls on a daily basis from people around the country seeking to file IVC filter lawsuits against Bard. Having seen the aftereffects of many dangerous medical devices and pharmaceutical recalls, we are aware of the very serious nature of the allegations made by Bard filter lawsuits. We are committing our firm’s extensive resources to providing the best IVC filter lawsuit representation possible.”
According to court documents, Bard IVC filter lawsuits share the following questions of fact: “All actions involve common factual questions arising from allegations that defects in the design of Bard’s retrievable inferior vena cava filters (“IVC filters”) make them more likely to fracture, migrate, tilt, or perforate the inferior vena cava, causing injury.” In simple terms, the plaintiffs allege that IVC filter complications harmed themselves or a loved one. The cases also allege that Bard had a responsibility to warn the public when officials first learned about IVC filter risks, according to court documents.
The 22 actions initially transferred to U.S. District Court in Arizona including cases originating from California, Florida, Georgia, Illinois, Michigan, Mississippi, Missouri, Nebraska, New Mexico, New York, Ohio, Pennsylvania, Tennessee, Texas, and Wisconsin, according to court documents. The JPML selected Arizona as the transfer court because Bard is headquartered in that district, according to court documents.
