Security Orchestration & Automation Response Leader CyberSponse Files Thorough Response to the Swimlane Litigation

Cybersecurity automation and orchestration has been a highly competitive technology space over the last 12 months. Since its 2012 inception, CyberSponse has filed multiple patents surrounding incident response management, role-based access control technology, numerous provisional patents around advanced automation and its unique approach to security operations orchestration.
[click here-->] In its response, CyberSponse, a leader in Security Orchestration & Automation Response, has developed a unique and innovative technology for incident response automation, playbook orchestration, and security tool integrations. The filing outlines the two-year timeline of events where evidence surfaced that Swimlane allegedly committed intellectual property & trade secret theft. CyberSponse’s mission has always been to simplify cybersecurity operations and provide organizations a more mature approach to security operations.
Over the course of 2014, Cybersponse engaged the law firm Snell & Wilmer seeking advice and counsel on its intellectual property protection, among other business related initiatives, as discussed in the response. This is the same law firm that has also represented Swimlane since its inception in late 2014, and most recently, also filed the complaint against CyberSponse.
Swimlane has chosen to use the legal process to resolve issues believed to be brought on by themselves, according to CyberSponse's response filing.
According to court documents and starting at page 8 of the [click here->] response filing, over the last two years CyberSponse has made numerous efforts to discuss its concerns of intellectual property and trade secret theft with Swimlane. It was also concerning in that Swimlane original offices were located just miles from CyberSponse in Phoenix, Arizona. Shortly after concerns arose, Swimlane then proceeded to relocate its entire operation from Arizona to its current location in Colorado.
According to the response filing, CyberSponse is not the only entity that has noted similarities between Swimlane and CyberSponse. A U.S. Government Agency representative said after using the [two] products, “I was shocked at how much Swimlane and CyberSponse look alike.”
According to the case materials, during the last couple of years, CyberSponse continues to experience first hand the number of alarming similarities of the Swimlane product to its own technology. Furthermore, all of CyberSponse’s attempts to resolve its concerns all ended with no good faith effort as Swimlane leadership refused to meet to discuss or provided any reasonable explanation to the concerning facts related to its product.
According to court documents, instead of resolving amicably, Swimlane chose to file a legal complaint the morning of the first day of the 2017 RSA Conference. CyberSponse finds this filing by Swimlane not only as a method to avoid reasonable resolution but also a disingenuous action that has been a pattern of Swimlane since its inception.
