Case Dismissed, Guidance Aviation Wins in Federal Court
Prescott, AZ (PRWEB) September 15, 2014 -- Note: For all references to court cases and actions in this release see: (Case 3:12-CV-08193-PGR).
A United States District Court of Arizona has dismissed all claims made by a former Yavapai College employee, Daniel Hamilton, against Guidance Aviation and its principal John Stonecipher. The Court held that the claims were without merit.
Hamilton had alleged that Guidance Aviation, which employs and trains veterans for careers as helicopter pilots, was not complying with the law by training too many veterans. On September 9th, 2014, a Federal Judge dismissed all claims against Guidance Aviation, John Stonecipher and his wife Amanda.
The Court confirmed what a U.S. Attorney, John Leonaro District of Arizona, had previously decided by not intervening in this action: that Mr. Hamilton was not able to meet the lowest burdens that our legal system requires.
“We finally had our day in Court. I am not surprised by the Court's rejection of Hamilton's Accusations. Last year, the U.S. Department of Justice made a similar decision, declining Hamilton's invitation to join his allegation against my company and its Prescott employees. In America, anyone can file a lawsuit, at any time, for any reason… I’m appreciative that the justice system could see through Mr. Hamilton’s assertions.” stated John Stonecipher, CEO and Founder of Guidance Aviation.
“I feel we've been vindicated,” Stonecipher added. “I am very grateful for all the support we've received from the community. I've been training and hiring Veterans as part of my professional life for nearly three decades. I am proud of my employees, Veteran and non-veteran alike, and my company’s commitment to reintegrating Veterans into the civil workforce and helping them start their careers as professional aviators."
Guidance Aviation is one of the largest employers of Veterans in the region. Last year, the United States Small Business Administration (SBA) recognized Stonecipher as the National SBA Business Person of the Year. Mr. Stonecipher was acknowledged for his exemplary work training Veterans by the Office of the Vice President. In acknowledging his accomplishments Dr. Jill Biden said “John…your commitment to the Veteran Community should be a model for all Americans.”
