In light of an October 21, 2015, Fox Business article about selling a home while going through a divorce, Realtor Carol Hertel, of RE/MAX Professionals, lists her top tips on how to accomplish this, while discussing the associated financial pitfalls for both parties.

Additionally, the process of selling a home during divorce is fraught with financial pitfalls that both parties might be unaware of, such as splitting up the biggest assets most couples have and how it should be done fairly.

“Divorce is a highly emotional and stressful time for both parties involved, and trying to sell the family home at the same time just adds to the misery,” said Carol, a Certified Real Estate Divorce Specialist. “Additionally, the process of selling a home during divorce is fraught with financial pitfalls that both parties might be unaware of, such as splitting up the biggest assets most couples have and how it should be done fairly.”

These pitfalls can be avoided, suggests Carol, by contacting someone that has not only been through a divorce personally, but has also helped many people through this process and has taken extra training, such as a Real Estate Divorce Specialist Training Course. Realtors who achieve this designation are trained in the legal and tax aspects of divorce that many divorce lawyers don’t even know, and can help both parties when it comes to selling a home during divorce. For instance, the spouse who moved out of the home as long as 6 years ago can still take a $250,000 exclusion when the house is sold, even though the spouse who stayed in the house also took a $250,000 exclusion.

According to the Fox Business article, the home is often the last item dealt with in a divorce, as it is one of the most emotionally charged aspects of a divorce. However, there are tips to ensure the process is as seamless as possible, first and foremost finding a Realtor who is completely neutral, such as Carol, a RE/MAX Hall of Fame recipient who works with a team that specializes in all aspects of divorce-lenders, mediators, financial planners, etc.

“Timing is also crucial,” said Carol. “Although your divorce might not coincide with optimal selling months, keep in mind that March and April are widely considered the best months to put your home on the market, while the winter months can be tough.”

It is also imperative, adds Carol, that despite any lingering acrimony, both parties need to be involved in the selling process, such as settling on the asking price and reviewing offers. If one person chooses to opt out of the process, the two still need to discuss their options, such as one buying the other out, if economically feasible. However, no matter what the circumstances might be, a trusted yet neutral Realtor can help get the best deal possible for both parties while educating them on the process.
