Attorney David J.P. Kaloyanides Wins First Amendment Violation Case
Chino, CA (PRWEB) May 09, 2016 -- Attorney David J.P. Kaloyanides, who is certified by the California Board of Legal Specialization, recently won a First Amendment Establishment Clause case against the Chino Valley Unified School District Board of Education in Freedom From Religion Foundation, Inc., et al., v. Chino Valley Unified School District etc., et al., in the United States District Court for the Central District of California (Case No. EDCV 14-2336-JGB). As the prevailing party, Mr. Kaloyanides filed and won a motion for an award of attorney’s fees on behalf of plaintiffs against the individual Board members of the Chino Valley Unified School District Board of Education. Plaintiffs sued alleging that the defendants violated the Establishment Clause of the First Amendment by instituting a policy and practice of prayer in its school board meetings.
The First Amendment’s Establishment Clause prohibits the government from making any law “respecting an establishment of religion.” Furthermore, according to court documents, the plaintiffs sought a declaratory judgment that the defendants’ conduct of prayers, Bible readings, and proselytizing at Board meetings violated the plaintiffs’ rights under the Federal and California constitutions and a permanent injunction enjoining the Board and its members from continuing to violate the plaintiffs’ constitutional rights, which was granted in part after the plaintiffs’ motion for summary judgment (Case 5:14-cv-02336-JGB-DTB).
The Court also granted in part the plaintiffs’ motion for an award of attorney’s fees. “We are very pleased the judge upheld the principle of the separation of church and state, particularly in the context of the public schools,” said attorney for the plaintiffs Kaloyanides. “School boards need to understand that they cannot impose their own religious views on the students of the public schools in their charge, nor on the parents of those students.”
