Mary Zogg, of Family Law Advocate advises fathers to educate themselves on their rights and what they are entitled to, when it comes to benefits and protections, especially prior to their child’s birth. For more than a decade, Mary has been handling family law cases concerning paternity, custody, divorce, child support, prenuptial and postnuptial agreements, and more.

“In family law in Florida, the sanctity of marriage provides parental rights to a father subsequent to a physical separation or breakup,” said Mary. “However, without the marriage contract, the father is without legal rights unless, and until, he obtains a court order giving him these rights.”

A recent Family Law Advocate blog says, “ The identity of the father on the birth certificate creates a presumption of paternity; however, this presumption is not conclusive; it can be overturned. To establish rights as a father who has not married the mother, you have to bring a court action called a paternity action.”

Additionally, with the birth of a child, a father in Florida is subject to the financial obligation of child support; however, without affirmative court action or agreement and acquiescence by the mother, he doesn’t have parental responsibility or rights to time share.
