New York Auto Accident Lawyer David Perecman Comments on Fatal Left-Hand Turn Accident That Killed 9-Year-Old

According to The New York Times, a man driving a Ford Expedition was attempting to make a left turn from DeKalb Avenue onto Clermont Avenue in Fort Greene when he hit another car and jumped the curb. The 59-year-old man ran into a group of pedestrians, pinning the boy under the car. The 9-year-old was declared dead at the accident site.
“Left-hand turns at intersections without a traffic arrow can be risky. If drivers attempting to drive across oncoming traffic do not use the right judgment, are distracted, or have compromised visibility, making a left-hand turn may cause serious accidents, like the one that killed the boy,” said Perecman.
A car making a left turn is almost always liable for an accident at an intersection when the other car was coming straight. Left-hand turns require the driver to be aware of vehicles traveling straight, in addition to bicyclists and pedestrians who may be crossing the street. Cars making the left turn must wait until it is completely safe before heading in front of oncoming traffic to make the turn, said Perecman, an auto accident lawyer with over 30 years of experience in New York.
According to the National Highway Traffic Safety Administration (NHTSA Sept. 2010), left-hand turns were the critical event that preceded the highest number of vehicular crashes, making up 22.2 percent of the accidents. The majority, 96.1 percent, of these intersection-related crashes were attributed to driver error, including recognition errors and decision errors.
The three people who were injured were taken to the hospital with minor injuries, reported The New York Times.
