David Perecman of The Perecman Firm Agrees with Federal Settlement in NY Disability Discrimination Case
New York, NY (PRWEB) July 17, 2013 -- David Perecman, founder of The Perecman Firm, one of New York’s civil rights violation law firms, agrees with the decision of the court that a western New York parks worker with vision in only one eye be offered a job promotion with parks maintenance in Erie County, along with $22,000 in back pay and interest.
“Employers working with blind and partially sighted people need to be aware of the rights conferred by the Disability Discrimination Act,” said Perecman. “A competent worker should not be hindered in his advancement by his inability to obtain a commercial driver's license because of a physical disability.”
The county employee, Timothy Slawek, claimed he was denied a promotion because only one of his eyes has vision. He filed the charge of discrimination with the Equal Employment Opportunity Commission (EEOC). The complaint said he was passed over for promotion because his vision prevented him from getting the commercial driver's license required in the job posting.
The consent decree filed in federal court in Buffalo resolved the government's civil complaint on behalf of Slawek.
“Employers must make ‘reasonable adjustments’ to barriers which hinder disabled people in their access to employment,” Perecman explained.
The consent degree is Civil Action No. 1:13-cv-00715 in the U.S. District Court for the Western District of New York.
This complaint was initiated by a charge (Charge No. 525-2009-00784) with the Equal Employment Opportunity Commission (EEOC).
