Stephen Danz & Associates File Wrongful Termination Lawsuit Against VSS International
Los Angeles, CA (PRWEB) January 06, 2016 -- Danz & Associates filed the suit in the Superior Court of California, Sacramento (Case No. 34-2015-00186016), on behalf of Marissa Vargas against VSS International. According to court documents, on August 21, 2015, the plaintiff (Vargas) was called at work and was informed that her husband was sent to the ER and was found to have a tumor in his chest, wherein the plaintiff left work after first allegedly informing her supervisor and obtaining permission. Vargas’ husband was later diagnosed with non-Hodgkin’s Lymphoma and chemotherapy sessions were initiated, resulting in the plaintiff having to care for and nurse him during and after these sessions.
The court documents state that the plaintiff allegedly asked for and received time off between August 22 and September 8, 2015, to help care for her husband. Also, according to court documents, at all times the plaintiff attempted to accommodate her employer’s needs and was allegedly never informed prior to September 11 that there had been any problems with her work or that the time off for her husband’s medical conditions had created any problems for her employer. However, on September 16, she was terminated from her job by the defendant.
Court documents state that at all times, herein, Vargas’ husband had a qualifying disability under the Government Code and was protected by provisions of the Fair Housing and Employment Act and Vargas was entitled to protection based on associational discrimination under the Government Code and other laws.
“Our client is requesting a trial by jury for all claims and issues so triable,” said attorney for the plaintiff, Stephen Danz, who focuses on employment law.
