David Tous Touts the Merits of Hiring an Attorney for Workers’ Comp

The system is so incredibly complex that just the benefit notices that are required to be sent to an injured worker by the insurance companies result in confusion, stress and uncertainty.

Originally, the California workers’ compensation system was designed so that an injured worker would be able to secure benefits without the need for representation by an attorney.

“However, the system has morphed so much over the years that there is a slim chance that an unrepresented injured worker will receive the maximum benefits available without the assistance of an attorney,” said David Tous, founder of Tous Law Group, which focuses on workers’ compensation. “The system is so incredibly complex that just the benefit notices that are required to be sent to an injured worker by the insurance companies result in confusion, stress and uncertainty.”

For those injured on the job, Tous lists the following three reasons to hire an attorney to help navigate the workers’ compensation system:

No. 1: Help receive the maximum benefits allowed. “Workers’ compensation injuries can often cause injured workers to feel that the injury has destroyed their life, and they soon begin to feel that the insurance company is their enemy and that they have no rights,” said Tous. “But an attorney can navigate the system for the injured worker to ensure that he or she receives the maximum benefits allowed and the best possible settlement.”

No. 2: Deal with insurance companies. The law, adds Tous, can oftentimes be unfair as an injury can displace a worker from their job temporarily, and many times permanently. “Insurance companies deny temporary disability, medical benefits and permanent disability, so having an attorney on your side fighting for you is essential,” said Tous.

No. 3: Offer expert advice. “An injured worker should seek representation so that they have an expert available to advise and assist them in the process,” said Tous. “The system was designed to provide injured workers with benefits. The insurance companies are in business to make money; they are not in business to ensure that the injured worker receives the maximum benefits allowed by law. Again, however, an attorney strives to secure the maximum benefits allowed by law for his or her clients.”
