Actos Lawsuits Move Forward, as Bernstein Liebhard LLP Notes Scheduling of Future Status Conferences in Federal Actos Bladder Cancer Litigation

According to an Order issued on August 26th, the federal judge overseeing thousands of claims in the Actos bladder cancer litigation underway in U.S. District Court, Western District of Louisiana, has scheduled the proceeding’s Status Conferences through December 2014. The litigation’s next conference is to be convened on September 26th at 10:30 a.m. (In re: Actos Product Liability Litigation, MDL No. 2299)

Actos Bladder Cancer Lawsuits
According to court documents, at least 2,500 Actos lawsuits involving bladder cancer allegations have been filed in the litigation underway in Louisiana. All of the lawsuits allege that Takeda Pharmaceuticals and other defendants concealed their knowledge of the bladder cancer risk associated with Actos, and failed to provide adequate warnings to the public and medical community. The litigation’s first Actos bladder cancer lawsuit will go to trial on January 27, 2014, while its second Actos bladder cancer trial will commence on April 14, 2014.
While the trials have yet to begin in the federal Actos litigation, court documents indicate that that some cases have gone before juries at the state level. In fact, the nation’s second trial of an Actos bladder cancer claim is currently underway in Maryland State Court. (An v. Nieberlein, 24-C12003565, Circuit Court for the City of Baltimore, State of Maryland.) In April, the nation’s first trial involving Actos bladder cancer allegations ended with a Los Angeles Superior Court jury awarding $6.5 million to a plaintiff who was diagnosed with the disease after taking Actos for four years. However, the judge overseeing the case granted Takeda Pharmaceuticals’ request to set aside the verdict. (Cooper v. Takeda Pharmaceuticals America Inc., CGC-12-518535, California Superior Court)
Actos lawsuits began to mount in courts throughout the country shortly after the U.S. Food & Drug Administration (FDA) warned in June 2011 that long-term use of the drug could increase the risk of developing bladder cancer. According to Bloomberg.com, Actos was also pulled from the market in Germany and France that month because of its association with bladder cancer.*
