Actos Lawsuits Mount as Claims in Federal Actos Bladder Cancer Litigation Near 2,700, Bernstein Liebhard LLP Reports
New York, New York (PRWEB) January 19, 2014 -- Actos lawsuits (http://www.consumerinjurylawyers.com/actos/Actos-Lawsuit.html) that allege long-term use of the Type II diabetes drug caused patients to develop bladder cancer continue to mount in the federal multidistrict litigation now underway in U.S. District Court, Western District of Louisiana, Bernstein Liebhard LLP reports. According to an updated case list issued by the U.S. Judicial Panel on Multidistrict Litigation on January 15, 2014, 2,692 Actos bladder cancer claims have been filed in the proceeding. Actos Lawsuits
According to court documents, all of the Actos lawsuits pending in the Western District of Louisiana allege that Takeda Pharmaceuticals concealed knowledge of the drug’s association with bladder cancer, and failed to provide doctors and patients with adequate warnings regarding this risk.
In 2013, three Actos lawsuits went to trial at the state court level, court records indicate. In April, an Actos bladder cancer plaintiff was awarded more than $6.5 million by a Los Angeles Superior Court Jury in September. In September, a Maryland State Court jury awarded $1.7 million to the family of a man who died of bladder cancer following long-term use of Actos. However, the judge presiding over the lawsuit overturned the verdict because the jury also found that the decedent’s decades-long smoking habit contributed to the development of the disease. (An v. The Actos litigation has been growing since June 2011, when the U.S. Food & Drug Administration (FDA) mandated that new information regarding the drug’s association with bladder cancer be added to the “Warnings and Precautions” section of the Actos label. At the same time, the agency warned that those patients who took Actos for a year or more could face an increased risk of developing the potentially fatal disease.
