Actos Lawsuits Move Forward, as Nevada Judge Denies Mistrial Bid in Actos Bladder Cancer Trial, Bernstein Liebhard LLP Reports

Actos lawsuits ( alleging that long-term use of the Type 2 diabetes drug caused patients to develop bladder cancer continue to move forward in federal and state courts throughout the country, Bernstein Liebhard LLP reports. According to court documents, the Nevada Circuit Court Judge overseeing an Actos trial currently underway in Clark County has rejected Takeda Pharmaceutical’s bid for a mistrial, after the company asserted that an article published by a local media outlet precluded a fair trial. The trial in question involves Actos lawsuits filed by two Las Vegas women who allegedly developed bladder cancer after using the medication for more than one year. According to their complaints, they have both been forced to undergo multiple surgeries to treat their cancer. The women are seeking a multi-billion verdict, which would be the largest ever awarded in Nevada.

Actos Bladder Cancer Allegations
According to court documents, the cases currently at trial in Nevada are among more than 3,000 Actos bladder cancer claims currently making their way through U.S. courts. The majority of these cases have been filed in a federal multidistrict litigation now underway in U.S. District Court, Western District of Louisiana. All of the claims accuse Takeda Pharmaceuticals and other defendants of concealing the association between Actos and bladder cancer from the public and medical community. On April 7, 2014, the jury hearing arguments in the first trial of an Actos lawsuit in the federal proceeding returned a multi-billion verdict favoring the plaintiff. According to court documents, the judgment consisted of $1.475 million in compensatory damages, and $9 billion in punitive damages. The punitive damages were split between Takeda, which was ordered to pay $6 billion, and Eli Lilly & Co., which was ordered to pay the remainder. According to a report from, the punitive damage award ranked as the seventh largest in U.S. history, and was assessed after a jury found the two companies acted with “wanton and reckless disregard” for patients’ safety.* (Allen v. Court records indicate that the Actos bladder cancer litigation began to grow following the publication of a U.S. Food & Drug Administration (FDA) alert in June 2011, which warned that use of Actos for more than 12 months had been linked to a doubling of the risk of developing bladder cancer.
