Allegations raised in this bladder cancer lawsuit are similar to those our Firm has heard from its own clients.

New York, NY (PRWEB) April 17, 2014

Bernstein Liebhard LLP notes recent developments in an Actos lawsuit (http://www.theactoslawsuitcenter.com/) trial currently underway in Nevada state court, which comes at the heels of a significant victory in Louisiana for a plaintiff whose federally-filed case associated the diabetes medication with bladder cancer.

The Las Vegas Review Journal reports that a plaintiff in this case testified on April 15th that she would not have taken Actos, which is manufactured by Takeda Pharmaceuticals, if she had known its alleged risk for causing bladder cancer. The trial for her lawsuit, which was filed last year in the state and includes another plaintiff whose claims similarly allege that the diabetes drug caused her to develop the disease, is currently taking place in Clark County District Court in Nevada, according to the article.* (Case Nos. A-13-680556, A-13-680922)

“We are pleased to the Actos trial in Las Vegas continuing to move forward, especially because allegations raised in this bladder cancer lawsuit are similar to those our Firm has heard from its own clients,” says Bernstein Liebhard LLP, a nationwide law firm representing defective medical devices and drugs like Actos. The Firm is currently offering free and confidential case evaluations to individuals who allegedly developed bladder cancer after taking the diabetes medication.

Actos Lawsuits

Less than two weeks prior to this Actos lawsuit update, the first federal trial for a lawsuit over the diabetes medication concluded on April 7, 2014 in the U.S. District Court, Western District of Louisiana with a $9 billion punitive damage award to the plaintiff, who also received $1.475 million in compensatory damages. A Bloomberg report published shortly after the verdict indicates that Takeda was ordered to pay $6 billion of the punitive damage award in this case, while Eli Lilly & Co., who served as co-defendant, was held liable for the remainder by a jury in Lafayette.**

A Case List updated April 15th by the U.S. Judicial Panel on Multidistrict Litigation (JPML) indicates that 2,993 additional claims against Takeda are now pending in a federal multidistrict litigation (MDL) established in the Western District of Louisiana. Claims in this proceeding similarly allege that the Actos manufacturer not only failed to warn about bladder cancer side effects that may allegedly stem from use of its diabetes drug, but also concealed vital safety information from the public and medical community. (In re: Actos Product Liability Litigation, MDL No. 2299)

According to court records, the number of lawsuits over Actos has continued to increase since June 2011, when the U.S. Food and Drug Administration (FDA) warned the public that individuals taking it for longer than 12 months may be associated with a doubled risk for new-onset bladder cancer.

Individuals who allegedly developed bladder cancer due to their use of Actos may be eligible to file an Actos lawsuit.
