NEWPORT BEACH, Calif., Nov. 2, 2021 /PRNewswire-PRWeb/ -- On Friday, October 1, 2021, California Governor Gavin Newsom signed Senate Bill 447 (Laird), which ensures the pain and suffering of all accident victims aren't forgotten. The new bill will amend existing section 377.34 of the Code of Civil Procedure. In the existing section 377.34 of the Code of Civil Procedure, if a person dies, not due to injuries suffered in the accident, their claim for personal injuries and all other damages incurred as a result of the accident, dies with them. I.e. if they die before receiving compensation for their damages from a heart attack, cancer or some other reason, their family or heirs do not have standing to proceed with the claim to collect compensation for the damages suffered by the original claimant. The claim was just closed without anyone collecting compensation for damages suffered by the original claimant. The signing of Senate Bill 447 changes that.
The newly signed senate bill will help guarantee accountability for all injury victims in California. The law will also prevent an injured victim's damages from suffering, pain, and disfigurement from being disregarded because the victim dies. The law was sponsored by the Consumer Attorneys of California and co-sponsored by the Consumer Federation of California.
