As AndroGel lawsuits (http://www.testosteronelawsuitcenter.com/androgel-lawsuit/) involving heart injuries allegedly associated with the use of the low testosterone treatment continue to mount in U.S. courts, Bernstein Liebhard LLP notes that a federal judge in Illinois has dismissed a racketeering lawsuit that questioned the tactics used to market certain medications, including AndroGel. The lawsuit, which had been filed in the U.S. District Court, Northern District of Illinois under the Racketeer Influenced and Corrupt Organizations Act, had accused Abbott Laboratories and AbbVie Inc. of colluding to force health insurers to pay unnecessarily for AndroGel and the Humira arthritis drug. But in an Order dated September 25, 2014, U.S. District Judge Robert Dow wrote that plaintiffs had failed to show that the drug makers "joined together" illegally with pharmacies and intermediaries to maximize sales of the medications. Among other things, plaintiffs allege that the manufacturers of low testosterone therapies failed to warn doctors and patients about their potential risks, and concealed those dangers from the public. Court records indicate that the litigation surrounding AndroGel and similar medications got underway shortly after the U.S. Food & Drug Administration (FDA) announced in January it was reviewing the cardiovascular risks associated with low testosterone treatments. On September 17th, a panel of FDA advisors voted 20-1 to recommend that the drugs’ labels be revised to make clear they have not been shown to lessen low libido, fatigue, muscle loss and other age-related symptoms. The advisors also voted by the same margin to recommend that the manufacturers of testosterone replacement therapies be required to conduct studies of their cardiovascular side effects. *
