All AndroGel Lawsuit Claims Filed in Northern District of Illinois Ordered Consolidated for Coordinated Pretrial Proceedings, Bernstein Liebhard LLP Reports

According to court documents, the Executive Committee of the U.S. District Court, Northern District of Illinois, has ordered that all testosterone lawsuits filed in that district involving AndroGel be consolidated for coordinated pretrial proceedings. According to an Order dated March 14, 2014, the docket, which currently consists of at least 30 AndroGel lawsuits, will be assigned to U.S. District Judge Matthew F. Kennelly. Testosterone Treatment Lawsuits
According to court documents, AndroGel lawsuits began to mount in courts around the country after the U.S. Food & Drug Administration (FDA) announced in January that it was reviewing the safety of low testosterone therapies. The FDA acted after two studies indicated the drugs might be associated with an increased risk of heart attacks, strokes and sudden cardiac death in certain men.
Court filings indicate that all of the complaints currently pending in the Northern District of Illinois claim that AndroGel caused plaintiffs to suffer heart attacks, strokes, dangerous blood clots, heart failure and other life-threatening cardiovascular problems. The complaints further allege that the manufacturer of AndroGel engaged in aggressive marketing that encouraged men to seek treatment for low sex drive, fatigue and other symptoms merely associated with aging. The lawsuits attribute the rapid growth in the use of testosterone therapy to this so-called "disease mongering," and further claim that these tactics caused many men to be prescribed AndroGel in the absence of a true medical need.
In addition to AndroGel, court filings show that a number of testosterone lawsuits involving similar allegations are pending in courts around the county against the manufacturer of Testim. At least two such claims were filed this month in the U.S. District Court, Eastern District of Pennsylvania. (Case Nos. 140301684 and 140302537). A Testim lawsuit was filed in U.S. District Court, Northern District of California in February. (Case No. No. 14-278)
