Defendants in an AndroGel lawsuit (http://www.testosteronelawsuitcenter.com/) have lost their bid for a stay in a case that alleges the low testosterone therapy caused the death of a California man. In a ruling issued on September 30th, U.S. District Judge Josephine Staton of the Central District of California remanded the testosterone lawsuit to Orange County Superior Court where it was originally filed, after finding that California-based McKesson Corp. was not a fraudulently joined defendant. Court records indicate that it is one of more than 200 such claims involving testosterone replacement therapy that are currently pending in U.S. courts, the majority of which have been filed in a federal multidistrict litigation now underway in U.S. District Court, Northern District of Illinois. Court records indicate that the litigation concerning low testosterone therapies such as AndroGel began to mount shortly after the U.S. Food & Drug Administration (FDA) announced in January it was reviewing the cardiovascular risks associated with the medications. On September 17th, a panel of FDA advisors overwhelmingly recommended that the drugs’ labels be revised to make clear they have not been shown to lessen low libido, fatigue, muscle loss and other age-related symptoms. The advisors recommended that the manufacturers of testosterone replacement therapies be required to conduct studies of their cardiovascular side effects. *
