Beau Soleil, LLC, Represented by Russ August & Kabat, Accuses Pacific City Shopping Center of Defrauding Tenants
Beau Soleil, LLC, represented by Russ August & Kabat, filed a complaint against DJM Capital Partners and PC Group Retail, LLC, owners of Pacific City Shopping Center, alleging that Pacific City deliberately lied about the concept behind LOT 579, a food hall, in order to trick them into taking space at the food hall.
HUNTINGTON BEACH, Calif., June 07, 2019 /PRNewswire-PRWeb/ -- DJM Capital Partners and PC Group Retail, LLC, owners of Pacific City Shopping Center were slapped with a law suit alleging that it deliberately lied about the concept behind LOT 579, a food hall, operated by the Center.
According to the Complaint filed by Beau Soleil, LLC, represented by Russ August & Kabat (Case No. 30-2019-01071802-CU-FR-CJC filed at the Supreme Court of California, Court of Orange), in order to attract tenants to take space in LOT 579, Pacific City falsely represented to prospective tenants that LOT 579 was going to be designed and operated just like the Anaheim Packing District, located in the old Sunkist Industrial Facility in Anaheim.
The Anaheim Packing District is a unique, highly curated eating and entertainment facility which features many unique eateries, vendors and constant entertainment functions to attract consumers to that destination. The lawsuit alleges that Pacific City led prospective tenants to believe that it would emulate the Anaheim Packing District model in order to induce them to take space at LOT 579 but never intended to actually do so. Instead, Beau Soleil claims that Pacific City built out a bland, vanilla food court to service the shopping center.
According to the First Amended Complaint, many of the tenants invested hundreds of thousands of dollars building out their restaurants, only to find that Pacific City did not provide entertainment and did nothing to model and promote LOT 579 consistent with the Anaheim Packing District Model. As a result of Pacific City's alleged wholesale failure to carry out its promises, LOT 579 has never been anything other than a dead space, devoid of traffic for most times of the day and night.
Pacific City is also alleged to have failed to disclose the fact that it owned or had a significant interest in two competitive restaurants at Pacific City Shopping Center, "The Bungalow Restaurant and Bar" and "BlueGold Restaurant" putting Pacific City in conflict with its tenants because promoting LOT 579 would divert traffic from its own restaurants.
Beau Soleil, LLC, which operates under the name Beau Soleil Kitchen and Bar is seeking over $1,000,000 in damages as well as the termination of its lease obligations. According to one of its owners, Larry Russ, "Beau Soleil and the other tenants of LOT 579 want Pacific City to keep its promise about making LOT 579 a unique dining experience and destination along the lines of the Anaheim Packing District."
