The Bell Law Firm Files Suit against Genzyme Corporation Alleging Fraud, Negligence among Other Claims
HIGHLANDS RANCH, Colo. (PRWEB) June 18, 2014 -- On June 17, The Bell Law Firm initiated a lawsuit against Genzyme Corporation in the District of Colorado (Case 1:14-cv-1684) alleging the manufacturer negligently marketed, distributed and sold impure and untested drugs that exacerbated the plaintiff’s condition.
According to court documents, Genzyme experienced a contamination of the drug Cerezyme sometime prior to June 2009, which the plaintiff had been prescribed for a condition known as Gaucher Disease.
"Cerezyme was a miracle drug for Gaucher patients, but Genzyme [allegedly] contaminated it with a dangerous virus, and cut doses to less than a third for many Gaucher patients in response to a shortage Genzyme itself created,” said Rachel Goldfarb, managing attorney of The Bell Law Firm’s Colorado office.
Court documents show The Bell Law Firm is alleging the plaintiff’s drug was substituted with a diluted and contaminated version of Cerezyme in the plaintiff’s treatments from 2010- 2011.
“Genzyme [allegedly] knew the diluted medication was experimental and dangerous but still decided to give it to certain Gaucher patients, including our client. Our client was deprived of FDA approved doses and instead injected with a live pathogenic virus, without his informed consent. As a result, he now suffers from an incurable cancer,” Goldfarb said.
The firm is alleging Genzyme knew the diluted version of Cerezyme was untested and unsafe, and that there was no evidence an impure formula would effectively treat the plaintiff’s condition.
“Congress enacted the Food, Drug and Cosmetic Act and the States passed their own pure food and drug laws over 70 years ago to protect against this type of conduct. We are hopeful that a jury will hold Genzyme and its partners responsible for their actions in endangering and forever altering the lives of thousands of patients, including our client’s,” said Goldfarb.
Court documents state that The Bell Law Firm is further alleging Genzyme operated a fraudulent scheme to collect revenues from this illegal marketing and distribution of the diluted Cerezyme formula.
The firm is requesting that the complaint be certified as a class action lawsuit to include additional plaintiffs with similar allegations, as well as their spouses.
