Biomet Hip Lawsuit Update: Bernstein Liebhard LLP Reports on Latest Status Conference in Federal Biomet Hip Replacement Litigation

According to a Memorandum issued on September 24th, the Court recently held a Status Conference, at which time a number of issues were discussed, including selection of bellwether cases, and pending and future dispositive motions. The Court also informed the parties that it will issue an order prior to the next conference regarding the selection of Biomet hip replacement claims for the proceeding’s first bellwether trials, as well as plaintiffs' request to appoint a special master for discovery. Biomet Hip Replacement Litigation
According to court documents, 652 Biomet hip replacement claims are now pending in the litigation underway in Indiana. The Biomet M2a Magnum is a metal-on-metal hip replacement system in which the ball and cup are made from a chromium cobalt alloy. Plaintiffs who have filed Biomet hip lawsuits allege that this design can cause the hip to shed dangerous amounts of metal debris, leading to serious complications, including metallosis, premature failure of the device, and significant bone and tissue loss. Many of those involved in the litigation have had to undergo revision surgery to have their M2a Magnum device removed and replaced, yet continue to suffer disability as a result of their alleged injuries.
In January 2013, the U.S. Food & Drug Administration (FDA) warned that metal-on-metal hip implants had been associated with higher rates of early failure compared to those composed of other materials. In addition to proposing new regulations that would subject such implants to more regulatory oversight, the FDA has advised recipients of all-metal hips to undergo metal ion blood testing if they experience any symptoms that would indicate their device could be failing.
