The U.S. Food & Drug Administration (FDA) warned in January 2013 that metal-on-metal hip implants like those named in the Biomet hip lawsuit were more prone to early failure compared to those made from other materials. Recipients of all-metal hips have been advised by the FDA to undergo metal ion blood testing if they experience any symptoms that would indicate premature failure, including pain, swelling around the joint, difficulty walking, and popping, clicking, or squeaking sounds emanating from the hip. The agency has also proposed new regulations that would subject such implants to more regulatory oversight, including stringent premarket testing.
In the U.S., court records indicate that at least 725 Biomet hip replacement lawsuits are pending in a multidistrict litigation underway in U.S. District Court, Northern District of Indiana, where Bernstein Liebhard LLP is actively filing claims.
