According to court documents, almost 900 Biomet hip lawsuits have been filed in the Northern District of Indiana, all of which allege that the metal-on-metal design of the M2a Magnum Hip Replacement System can cause painful and disabling complications, including metallosis, chronic pain, and loss of mobility. According to an Order issued in December, the Court is contemplating scheduling as many as five bellwether trials in the proceeding. Those trials would most likely take place in June, August, October, and December of 2015 and January 2016.
In January 2013, a safety communication issued by the U.S. Food & Drug Administration (FDA) as part of its review of metal-on metal hip implants cautioned that such devices were more likely to fail prematurely than other artificial hip designs. The agency said patients implanted with metal-on-metal hip implants should seek medical attention if they experience any symptoms that could indicate a problem with the device. At the same time, the FDA said it was proposing new regulations that would subject this class of devices to greater regulatory scrutiny.
