According to court documents, more than 1,600 Biomet hip lawsuits are now pending in the Northern District of Indiana, all of which allege that the meta-on-metal design of the M2a Magnum hip caused plaintiffs to suffer serious and debilitating complications, including chronic pain, metallosis, and premature device failure.
The Biomet hip replacement settlement proposal was announced in the Northern District of Indiana on February 3, 2014, and according to court documents could ultimately resolve hundreds of claims involving the M2a Magnum hip. Under the terms of the settlement, plaintiffs who received one of the affected Biomet hip replacements as part of an initial surgery that was rectified more than 180 days after it was implanted would eligible for a base award of $200,000.
To participate in the settlement program, plaintiffs must have filed their Biomet hip lawsuits no later than April 15, 2014. However, according to report from the Journal Gazette, Biomet hip recipients who did not file by that deadline may still be able to pursue individual claims against Biomet. Biomet has reserved the right to opt out of the settlement agreement if fewer than 90% of those eligible to participate refuse to do so.*
According to a safety communication issued by the U.S. Food & Drug Administration (FDA) in January 2013, metal-on-metal hip implants, which consist of a chromium/cobalt acetabular ball and femoral cup, may be more vulnerable to early failure compared to devices made from other materials. The agency has advised patients fitted with all-metal hip implants to undergo metal ion blood testing if they experience pain, swelling, or other symptoms that could be an indication that their hip is failing.
