Court records indicate that more than 700 Biome hip lawsuits have been filed in the Northern District of Indiana on behalf of individuals who suffered metallosis, pseudotumors, premature device failure, and other serious complications, allegedly due to the Biomet M2a Magnum Hip Replacement System. All of the cases involve similar allegations involving the metal-on-metal design of the M2a hip, which the lawsuits claim can shed dangerous amounts of toxic metal ions into recipients’ tissue and blood stream, leading to failure of the device within just a few years of implantation and need for revision surgery.
On January 17, 2013, the U.S Food & Drug Administration (FDA) issued a safety communication regarding all-metal hips, after finding that such devices were more prone to early failure than those made of other materials. Among other things, the agency has proposed regulations that would prevent metal-on-metal hips from being approved via the FDA 510(k) clearance program, which allowed the devices to come to market without premarket clinical testing. The proposed regulations would also require the manufacturers of metal-on-metal hips already on the market to conduct safety studies of those products in order to continue selling them. Finally, the FDA advised metal-on-metal hip recipients to undergo blood testing for high levels of metal ions if they experience any symptoms that could be a signal that their hip is failing.
