According to a Memorandum issued on December 10, 2013, U.S. District Judge Robert L. Miller Jr. deemed such an appointment unnecessary, as he anticipates being able to rule on any discovery issues that arise. However, Judge Miller did authorize Magistrate Judge Christopher A. According to court documents, nearly 800 Biomet hip lawsuits are pending in the federal litigation underway in the Northern District of Indiana. Plaintiffs who have filed claims in the proceeding allege that the metal-on-metal design of the M2a Magnum Hip Replacement System is defective, and prone to shedding dangerous amounts off toxic metal ions into the surrounding tissue and blood stream The complaints further allege that this can cause serious complications, including metallosis (metal ion poisoning) and premature failure of the device.
In January 2013, the U.S. Food & Drug Administration (FDA) advised recipients of metal-on-metal hips to undergo blood tests for elevated levels of metal ions if they experience any symptoms of a failing hip. The agency issued the advice after its review of metal-on-metal hip implants revealed they were more likely to fail within several years of surgery than those made from other materials.
