Bruce Loren, Esq. Appointed Litigation Counsel for the AGC in Its Fight Against Palm Beach County Proposed Ordinance Mandating Preference Quotas for Construction Business
PALM BECH GARDENS, Fla. (PRWEB) October 23, 2018 -- Bruce Loren, Esq., partner at the law firm Loren & Kean Law, recently made a presentation to the Palm Beach County Board of County Commissioners to protest the proposed ordinance by the Palm Beach County Board of Commissioners that would require significant preferences to be set aside for women and minority-owned contractors on public bids. Should the county accept this proposal, the AGC will continue the fight in federal court claiming that the new program is unconstitutional and should be overturned.
The presentation was focused on granting the AGC access to documents and data utilized in the Mason Tillman Associates (MTA) study, which has been used as a basis for the proposed ordinance. The study, which cost taxpayers $750,000, makes conclusions that appear to be biased due to a lack of key data. MTA has also refused to turn over key backup information for the statistical data, assumptions and conclusions contained in its report, even to the county commissioners.
Aside from making this very important presentation in front of the Palm Beach County Board of County Commissioners, Bruce Loren also penned an op-ed piece that was posted in the Palm Beach Post. In the article, he highlights that the AGC has always been on the side of providing equal opportunities to women-owned and minority-owned contracting companies. The county plans to create a new program that will replace the current Small Business Enterprise program. This new program will include “set aside preferences” for women-owned and minority-owned businesses in Palm Beach County for all public construction projects. “To revoke this program is an insult to all the hardworking men and women, of all races, who have successfully grown their construction businesses by using Palm Beach County’s existing Small Business Enterprise program”.
