California Federal Court Overseeing Byetta Lawsuits, Other Incretin Mimetic Claims Adds New Cases in November, Bernstein Liebhard LLP Reports

More than two dozen new claims were filed over the past month in a federal litigation involving Byetta lawsuits (, as well as cases over similar diabetes medications, Bernstein Liebhard LLP reports.

A Case List updated on November 17th indicates that 566 claims over a class of Type 2 diabetes medications referred to as incretin mimetics have now been filed in the U.S. District Court, Southern District of California, where a federal proceeding continues to move forward. Plaintiffs in these lawsuits allege pancreatic cancer, pancreatitis and even thyroid cancer caused by Byetta, Januvia, Victoza and other products. Last month, the same court documents showed 540 diabetes drug lawsuits pending in the litigation, which reflects the filing of 26 new cases since October 15th. Byetta Lawsuits

All Byetta lawsuits, as well as claims involving Victoza, Januvia and other products now filed in the Southern District of California similarly claim that the drugs’ manufacturers failed to adequately warn about the serious pancreatic side effects plaintiffs are alleged to have suffered . Claims in this litigation have continued to increase since March 2013, when the U.S. Food and Drug Administration (FDA) alerted the public of a previously unpublished study that found precancerous changes in the pancreatic cells of incretin mimetics users. The federal agency said at the time that the alleged link had not been confirmed, but that its review was ongoing.

In addition to Byetta lawsuits filed in federal court, recent records show a number of cases also consolidated in a state-level litigation established in California Superior Court.
